About these Terms

These Terms govern your use of Testify's app, website, and related services (the “Service”). The Service is operated by Testify, LLC (“Testify,” “we,” “us,” or “our”). By creating an account through a process that presents these Terms and asks you to accept them, you agree to them. If you do not agree, do not create an account.

Our Privacy Policy explains how we handle personal information. Our Community Guidelines provide more detailed conduct rules and form part of these Terms. If you use an additional feature that has its own terms, we will present those terms when appropriate.

Who can use Testify

You must be at least 16 years old, or older if the law where you live requires a higher minimum age for this Service. You must provide your real date of birth when asked and must not use another person's account to get around an age restriction. We may restrict or remove accounts that do not meet the applicable age requirement.

If you are under the age of legal majority where you live, please review these Terms with a parent or legal guardian. Where applicable law requires their consent for your use of Testify or a particular feature, you may use it only after that consent has been obtained. We may limit features or apply additional protections to teen accounts.

You may not use Testify if we have suspended your account, unless we authorize your return, or if applicable law prohibits your use. Any eligible Testify user, including a user aged 16 or 17, may create and manage a community. If you present a community as belonging to a church, ministry, or other organization, or claim to act on its behalf, you must have that organization’s permission. Do not imply an official affiliation where none exists.

Your account

Give us accurate account information and keep it reasonably up to date. Protect your login credentials and tell us promptly at uche@testifyhub.co if you believe someone has accessed your account without permission. You are responsible for activity through your account to the extent permitted by law. You may not impersonate another person, church, ministry, or organization.

Sharing on Testify

Testify lets people share testimonies and participate in faith communities through the features available in the app. You remain responsible for the content you post, including words, photos, recordings, comments, and profile information (“Your Content”). You retain your ownership of Your Content. Post only material you have the right to share, and obtain any required permission before posting another person's name, image, voice, story, or copyrighted work.

Choose your audience carefully. Depending on the feature and its settings, posts may be visible to other users, members of a community, or the public. People who can see a post may copy or share it outside Testify. Do not assume that joining a church community makes a post confidential or that its administrators can keep it private. The app should show who can see content before it is posted; our Privacy Policy should explain the actual visibility and administrator access rules.

Take special care with prayer requests and testimonies about other people. Do not disclose someone else's diagnosis, personal crisis, contact details, location, or other sensitive information without appropriate permission. Do not post information that could put a child at risk. Personal stories and expressions of faith should not be presented as guaranteed medical, financial, or other outcomes.

Permission to use Your Content

When you submit Your Content, you give Testify a nonexclusive, worldwide, royalty-free license to host, store, reproduce, adapt for technical display, transmit, and show it as reasonably needed to operate the Service according to the audience settings you choose, maintain safety, and comply with law. We may use service providers to perform these functions on our behalf. This license does not transfer ownership of Your Content to us.

We will seek separate permission before using your identifiable testimony, name, image, or voice in an advertisement or an external promotional campaign. Posting on Testify does not give a church or another user permission to republish your content outside the audience and sharing tools available in the Service. The license ends when Your Content is deleted from our systems, except for limited retained copies needed for lawful reasons, security, backups, or disputes, as explained in our Privacy Policy. Copies made independently by others may remain outside our control.

Community rules and safety

Use Testify respectfully and lawfully. You may not:

• Bully, threaten, stalk, harass, or expose another person's private information;

• Sexually exploit, solicit, groom, or endanger a minor, or share child sexual abuse material or nonconsensual intimate images;

• Post scams, deceptive fundraising appeals, impersonations, spam, or content that infringes another person's rights;

• Encourage violence, self-harm, dangerous medical decisions, or coercion of vulnerable people; or

• Circumvent account restrictions, manipulate engagement, or interfere with the Service.

Our Community Guidelines explain these rules in more detail. Community creators and administrators, including those aged 16 or 17, may adopt additional rules for their spaces if those rules are consistent with these Terms and applicable law. They must not use their role to harass members, disclose private posts, or claim authority they do not have. A community or church affiliation does not mean that Testify endorses, verifies, or supervises that organization or its members.

To report something in the app, select Report Content for a post or other content, or Report User for an account. You may also email uche@testifyhub.co with a description of the concern and enough information for us to locate it. If you believe a child is being exploited or someone is in immediate danger, contact local emergency services; you can also report the account or content to us. Do not download or forward suspected child sexual abuse material.

We may review reports and restrict visibility, remove content, limit features, suspend accounts, or terminate access when we reasonably believe these Terms or the Guidelines have been violated, or when action is needed for safety, security, or legal compliance. We may act urgently when needed. Email uche@testifyhub.co if you think we made a mistake. We cannot promise to review every post before it appears or prevent every harmful interaction.

Churches and other communities

Any eligible user may create and administer a community. Community administrators may manage their communities and see information made available to their roles in the Service. Membership alone does not give them unrestricted access to your account or permission to use your information for unrelated marketing, fundraising, or publication. Administrators must respect members' privacy, obtain permissions they need, and follow applicable safeguarding rules. Any separate agreement between Testify and an organization may govern that organization's additional services.

Testify's rights and acceptable technical use

Testify and its licensors own the app, its software, design, name, and other materials, excluding Your Content and third-party materials. We give you a limited, nontransferable right to use the Service while you follow these Terms. Do not scrape users' profiles or stories, gain unauthorized access, disrupt the Service, or use its content to build unauthorized databases. Nothing in these Terms removes rights you have under applicable law.

Privacy and account deletion

Our Privacy Policy describes the personal information we collect, how it is used and shared, retention, and choices available to you, including those for teen users. You can delete your account by selecting Delete Account in Settings. If you need help with account deletion, email uche@testifyhub.co. Deleting your account may not erase copies that other users independently saved or content retained for limited lawful purposes, as described in the Privacy Policy.

Other people's content and important decisions

Testimonies and other user posts reflect the views and experiences of the people who share them. Testify does not verify every claim, guarantee an outcome, or provide medical, mental health, legal, financial, or emergency services. Do not delay urgent help or stop treatment based on something you read or hear on Testify. In an emergency, contact local emergency services.

The Service may contain links to services run by others. Their terms and privacy practices may apply when you use them.

Availability, disclaimers, and liability

We may change, pause, or discontinue features for product, safety, security, or legal reasons. We aim to keep Testify available, but uninterrupted access cannot be guaranteed. Keep your own copies of material important to you.

To the extent permitted by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. To the extent permitted by law, Testify is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Subject to nonwaivable rights and the exceptions below, Testify's total liability for claims arising from the same event or related events is limited to the greater of US$100 and the amount you paid Testify for the relevant Service in the preceding 12 months.

These limits do not exclude liability for fraud, willful misconduct, or any injury, consumer remedy, privacy right, or other liability that applicable law does not permit us to exclude or limit. They do not excuse us from our own legal obligations. If a separate organizational agreement applies, it may set different terms for that organization.

Ending your account and changes to these Terms

You may stop using Testify and delete your account as described above. We may suspend or end your access for serious or repeated violations, safety or security concerns, or legal requirements. Where reasonably practicable, we will explain material enforcement decisions and how to request review.

We may update these Terms as the Service or law changes. We will publish the updated version and its effective date, provide appropriate notice of material changes, and seek renewed agreement where required. If you do not accept a change requiring agreement, you may stop using the affected Service. Changes do not retroactively remove rights you already have.

Governing law and contact

Subject to mandatory laws that protect you where you live, Maryland law and applicable U.S. federal law govern these Terms. Disputes may be brought in courts with jurisdiction in Maryland, without taking away any right a consumer has to bring a claim in another court under mandatory local law. These Terms do not require arbitration or waive class actions.
